Terms of Service

1. Acceptance of Terms

By accessing or using DevGhouse ("the Platform"), including DevGhouse App, DevGhouse Marketplace, and all related services, you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Platform Role — No Liability

DevGhouse is a technology platform only. We provide tools and infrastructure for users to create profiles, upload content, list digital products, and transact with other users. We are not a party to any transaction between users. We do not verify, endorse, warrant, or guarantee any content, product, service, or user on the Platform.

DevGhouse assumes zero responsibility and zero liability for any content uploaded, products sold, disputes between users, or outcomes resulting from use of the Platform. You use the Platform entirely at your own risk.

3. User Content & Uploads

By uploading any content (code, files, images, videos, documents, or any other material) to the Platform, you represent and warrant that:

• You are the rightful owner of the content or have all necessary rights, licenses, and permissions to upload and distribute it.
• Your content does not infringe on any third-party intellectual property rights, copyrights, trademarks, or any other rights.
• Your content does not contain malicious code, viruses, or harmful material.
• Your content complies with all applicable laws and regulations.

You are solely and entirely responsible for all content you upload. DevGhouse does not review, screen, or verify uploaded content and assumes no responsibility for it.

4. Content Storage & Access

Content uploaded to the Platform is stored on our servers. You acknowledge and agree that:

• Paid products (files, code, courses) are stored on our servers and are inaccessible to buyers until payment is completed.
• We may store, cache, and process your content as necessary to operate the Platform.
• We reserve the right to remove any content at any time, for any reason, without notice.
• We do not guarantee permanent storage of your content. You are responsible for maintaining your own backups.

5. Marketplace Transactions

All transactions on the Marketplace are between the seller and the buyer. DevGhouse:

• Is not responsible for the quality, accuracy, legality, or fitness for purpose of any product sold.
• Does not guarantee any product will work as described or meet buyer expectations.
• Is not liable for any loss, damage, or dispute arising from any transaction.
• May facilitate payment processing but is not a party to the transaction.

6. Intellectual Property

You retain ownership of content you upload. By uploading content, you grant DevGhouse a non-exclusive, worldwide, royalty-free license to store, display, distribute, and make available your content as necessary to operate the Platform and facilitate transactions.

7. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We disclaim all warranties including but not limited to merchantability, fitness for a particular purpose, non-infringement, and accuracy.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEVGHOUSE AND ITS OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, arising out of or related to your use of the Platform, whether based on warranty, contract, tort, or any other legal theory.

Our total aggregate liability shall not exceed the amount you paid to DevGhouse in the 12 months preceding the claim, or $50, whichever is less.

9. Indemnification

You agree to indemnify, defend, and hold harmless DevGhouse from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Platform, your content, or your violation of these Terms.

10. Termination

We may suspend or terminate your account at any time, for any reason, without notice.
